GENERAL INFORMATION ON PRIVACY POLICY FOR USING THE OKTOPRO PLATFORM AND PERSONAL DATA PROTECTION
Oktopro EOOD (hereinafter referred to as “Oktopro”, “we” or “us”) is a responsible Internet company based in the Republic of Bulgaria; it takes seriously its responsibility to preserve the privacy of the personal data of its users, as well as the protection of their personal data to which Oktopro has or authorizes third parties to have access in connection with the functioning of the platform created by Oktopro.
Oktopro is a commercial company that does not represent an intermediary, nor does it participate in any way in the selection of contractors and/or subcontractors who use the platform to make contact, to communicate and negotiate the provision of services with third parties who use the platform. Each registered user makes an individual decision on the type of information they provide to a third party who uses the Oktopro platform subject to fulfillment of their contractual relations. Oktopro is not a party and shall not be held responsible in the event that a contracting party and/or contractor who came in contact through the Oktopro platform does not comply with the agreed conditions, terms and/or if the respective user is in breach of any legal requirement or has not notified the respective local authorities competent to issue the relevant licenses, permits and/or other administrative acts and/or have the authority to carry out the relevant inspections and/or take the appropriate actions against the contracting authority/contractor who uses the platform. Oktopro does not provide recruitment services and/or hiring services and does not carry out mediation for employment abroad.
Personal data is defined as any specific information that pertains to you through which you can be identified. According to the GDPR (General Data Protection Regulation) or “the Regulation” – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), “personal data” means any information relating to an identified or identifiable individual (“data subject”); an identifiable individual is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that individual. Personal data is also contained in the information about your real name, address, telephone number, payment details, your passwords to access our website, etc. Data which cannot be linked to your real identity – directly or in combination with other data – are not considered personal data and are not considered as such.

Oktopro collects and processes the necessary personal data according to the current personal data legislation in the Republic of Bulgaria and the supranational law of the European Union. Oktopro processes personal data if there is legal basis for the process of data and/or when, for the purpose of operating the platform and using its functionality, it is necessary to use certain personal data. Every user of Oktopro’s platform declares and guarantees that he/she is at least 18 years of age, has proper capacity, and is able and entitled to enter into valid legal transactions, to be a holder of rights and to assume an obligation personally on his/her own behalf, or is a legal representative or an authorized person of a company he/she represents.
The use of services on the Oktopro platform is only possible upon registration. Registration is done by the individual or legal representative/attorney, and registration is not allowed on behalf of third parties except in the cases provided for by the law. Upon registration, it is required to fill in data about individuals or traders, and each user on the platform declares upon registration that he/she is authorized to do so. Each registering person is required to provide correct, up-to-date data and keep them as such for the purposes of the platform’s work. In the case of inaccurate data, Oktopro shall be entitled to suspend the services for the respective user on the platform until the removal of the inaccurate data.
Each registered user shall be responsible for any actions and/or lack thereof which were taken through his/her generated account – the username and password for access. In the event of unauthorized interference in your account and/or any unauthorized access to the account, you shall be obliged to immediately notify Oktopro in order to take appropriate actions.
By registering, you declare that you agree and accept to be the addressee of electronic statements within the meaning of Art. 5 of the Electronic Document and Electronic Certification Services Act.
The Oktopro platform enables users to store information about their work and about their work permits and/or other files the user finds relevant, etc., that each user provides to third parties via the platform in his/her own judgement. This information is in addition to the requests or offers for work by users of the platform. All files uploaded by the user are only accessible to him/her, and the user alone decides who to share them with, and whether to provide them to third parties using the platform. Each user guarantees and declares that he/she is entitled to store and use the content associated with his/her user account and that you have the right and agree that all content and/or parts thereof will be sent to third parties using the platform. Each user is personally responsible for both the lawfulness of the use of personal data and the authenticity of that data; the transmitted data is visualized in the account which they are sent to.
Users of the Oktopro platform are responsible for their storage and are required to protect the personal data, documents and/or information voluntarily provided to them by third parties that are also users of the platform. Oktopro shall not be held responsible for the use of information provided but only ensures the security of the personal data stored on the platform from unauthorized interference from third parties.
This policy of privacy and use of the Oktopro platform applies only to the personal data of each user of the platform and/or the website of Oktopro through the following website: www.okto.pro or www.oktopro.com. The policy shall not be implemented or applied to third parties, including in the event that the user uses other websites and/or services not owned by Oktopro or not under the control of Oktopro.

Every time you contact us or access the Oktopro platform (okto.pro) and/or our website (www.oktopro.com), you provide us with your personal data. In order for you to be able to use the services of Oktopro, Oktopro needs to collect, process and store your personal data. Oktopro strives to implement all new and best practices in the field of personal data protection, working towards organizing work processes so as to minimize the data it needs. Your personal data is processed and stored in a way that ensures its maximum security and protection.

The contact form on our website (www.oktopro.com) uses FormSubmit (formsubmit.co), a third-party service that processes the form data and keeps it for 30 days.
In most cases, Oktopro processes your personal data for the purpose of establishing the relevant contractual relationships between the persons concerned, using the Oktopro platform and/or between the data subject and Oktopro.
It is also possible that we process your personal data in order to comply with the obligations provided for under the law and/or another regulation (e.g. for the purposes of the tax law and/or for the purposes of the rules of civil procedure and/or commercial procedure). Some of the personal data you provide may be provided to the competent authorities of the Republic of Bulgaria and/or a third party to comply with the laws of the respective countries.
With regard to all registered users, Oktopro collects, processes and stores the history of the submitted queries and the services provided to the user that can serve for the purposes of statistical and marketing analysis, system testing, maintenance and development, as well as for us to respond to complaints, disputes or claims.
The use by an individual of the functionality of the Oktopro platform and/or services provided by our website requires registration and/or password for authorized access. Upon registration, the individual user provides us with the minimum personal data and correspondence data required. These data are used for the purposes of the platform and services provided by our website to ensure your full use of them.
The provision of personal data by users of the Oktopro platform is voluntary and the use of some of its functionalities, such as the selection of contracting party and/or contractor and/or subcontractor, as well as the conclusion of contracts between them.
In case of incomplete personal data, the User may not be able to use the functionality of the platform in full, or access to certain panels might be limited.
Users using the Careers service on the website of Oktopro should keep in mind that in order to access the service in full, it is possible that personal data be required and stored, including name, date of birth, photograph, social network account, mobile/landline telephone number, address for submission and receipt of documents, e-mail address, bank account for payment, documents relating to work status and/or method of insurance, as well as documents relating to legal residence on the territory where the services will be provided. These data are necessary to demonstrate fulfillment of certain administrative requirements, if this is necessary for the successful, timely and quality implementation of the services provided. We collect this data both for the purposes of the service we provide and in relation to the applicable law.
The personal data provided by the users of Oktopro may be provided at the request of state and/or administrative bodies and/or establishments (for example but not limited to: the Commission for Personal Data Protection, the National Revenue Agency, etc.) in connection with alerts, complaints, inquiries and/or procedures initiated before and/or by them; these data may also be provided to third parties (including third countries) for the purposes of administrative and tax control, safety, prevention and/or detection of misconducts and criminal offences.

Oktopro processes and stores only data provided voluntarily and the responsible entity is responsible for the timeliness and lawful use of these data when using the Oktopro platform. Each user is responsible and undertakes not to provide Oktopro with data of third parties in violation of their rights to protection of personal data, as Oktopro is not obliged to control the process of provision of data of third parties and whether they have provided their personal data with their knowledge and/or consent, in compliance with the form provided for by the law and the relevant legal requirements for the protection of personal data.
The users of the platform have unlimited and personal responsibility regarding the personal data of third parties provided to and stored within the Oktopro platform without their knowledge and/or without duly obtaining their consent in accordance with the rules of the applicable data protection legislation, irrespective of the type of data and/or the purposes for which they are provided. Each user is obliged to immediately remove the personal data and/or information and/or document containing personal data accessible through the Oktopro platform for which they knew or suspected elimination of the legal basis for collecting and processing of the respective personal data and/or that these were inadequately collected without the knowledge and/or consent of the data subject.
The Oktopro platform does not provide services and cannot be used by minors, therefore persons under the age of 18 cannot and do not have the right to register with the platform through its website: www.oktopro.com. The users of the platform are obliged not to register persons under the age of 18 and not to use personal data of persons under the age of 18. In the event of an alert and/or finding an infringement in connection with these rules, namely if it is found that personal data of persons under the age of 18 is used within the platform, Oktopro is entitled to immediately terminate the user’s access, delete immediately or store the information on the unauthorized use of personal data of a minor if a legal order obliges us to do so, and to immediately notify the competent authorities of the violation committed by the respective user, and provide his/her data to the relevant competent authorities.
Any user who suspects that personal data of minors are used within the platform is obliged to contact the personal data operator of Oktopro immediately in order to take the appropriate sensitive data protection measures and to stop any violations.
Oktopro does not carry out selling, unauthorized sharing and/or provision and/or dissemination of personal data of its users to third parties, except in the cases when a legal act or regulation from a supranational legislation requires us to do so, and if this is not necessary for the purposes of a contract between the users and Oktopro and/or the users of the Oktopro platform. Any user who has entered into a contractual relationship with a user of the Oktopro platform agrees that his/her personal data may be shared with other users of the Oktopro platform only if the data subject has entered into contractual and/or other relations with those other users – in connection and on the occasion of using the Oktopro platform.
Each user of the platform is aware of and agrees that Oktopro may, if necessary, submit personal data processed and stored by it to third parties, including but not limited to: subcontractors and/or contractors, for the performance of the services provided by the data subject, to which he/she is a party, as well as for the use of the platform’s functionalities.
For the purposes of personal data storing and protection, Oktopro may also have the right to engage third persons – specialists in the relevant field and personal data protection – to ensure optimal security for the integrity, protection and unnoticed change of Oktopro’s systems and databases, for example but not limited to: controlled access to the premises where Oktopro’s servers are located, the use of secure servers and connectivity, where possible – data encryption and other appropriate measures.
Oktopro retains your personal data for the period during which you maintain your account in our platform where any user has the right to ask for or delete his/her own account. By deleting a user profile, an automated system also deletes all personal data provided when using the account deleted by the user. On a legal basis and/or for statistical processing purposes, Oktopro may retain and store certain personal data even after closing/deleting the account.
When determining the period for personal data retention, Oktopro also takes into account all foreseeable periods required in relation to an inquiry into a complaint and/or alert made by and/or against a user, as well as other requirements of regulations binding that even after a user account has been closed, certain personal data must be retained for the purposes and/or needs of third parties (e.g. data retention in relation to accounting and/or insurance accountability under the acting Bulgarian legislation is maintained for a period of 10 calendar years).
The personal data provided in relation to the use of a service provided by Oktopro are retained for at least the period for which a complaint and/or other warranty claims can be filed against the data subject who provided a service to third parties – users of the Oktopro platform in relation to the implementation of the rights and interests of Oktopro and/or relating to the protection of the rights and interests of third parties that have used the service of the data subject.
By registering, the user agrees that his/her personal data will be used for the purposes of statistical processing, except in case of explicit notification to Oktopro that the user withdraws his/her consent that his or her personal data will be processed for statistical purposes.
When the basis on which Oktopro stores personal data of the data subject no longer exists, the personal data of the latter shall be destroyed in such a way that after their destruction they would not recover completely and/or in part and/or be reproduced otherwise.
In order to ensure the security and integrity of the personal data processed and stored by Oktopro, Oktopro has taken the necessary organizational and technical measures to implement different methods and systems to prevent unauthorized access, loss and/or other forms of unauthorized processing of personal data of users who are subjects of protection. The personal data of users, if stored, are accessible only to employees and/or qualified subcontractors authorized by Oktopro (or their respective employees) who need access to the data in order to fulfill their obligations arising from the relations between Oktopro and ensuring the security and integrity of the personal data of the subject of processing.
Any individual who is a user of the Oktopro platform may and is entitled to:
The exercise of these rights is free of charge and the user is required to send a written request to Oktopro’s data protection officer containing the exact data which are subject to processing, as well as which of the rights he or she wishes to exercise.
Claims are exempt from fees and charges unless they are unfounded and/or excessive (in the case of repeat requests despite a rejection). In such cases, Oktopro may refuse to process and take the requested action and/or impose a fee to cover the administrative costs for correspondence with the user, providing information and/or taking certain action in relation to a request made by the user.
The period within which Oktopro should deliver an opinion in relation to the rights exercised by the user and the request made to Oktopro is within 30 days of receipt of the latter. If necessary, Oktopro may extend this period by up to two months, depending on the complexity of the request made and/or the number of queries to be processed for that use.
Periodically, Oktopro is entitled and may change the policy of privacy and use of the Oktopro Internet platform and/or website prepared and published on www.oktopro.com or www.okto.pro in relation to the protection of the personal data of our users, and the users of our Internet platform will be notified of the changes made via an automatically generated message in the platform.
Any user who is a data subject, whenever he or she considers his or her personal data protection rights violated, can file a complaint to the competent supervisory body of the Republic of Bulgaria – the Commission for Personal Data Protection. More information can be found at www.cpdp.bg. Please note that according to the GDPR, you can file a complaint to the competent supervisor located in the country where you reside, work (where your workplace is located) and in a country where you believe that Oktopro has breached your personal data protection rights.
